Will I be able to get my DUI case overturned?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

What will happen if my husband refused to take breathalyzer?

Carlos Humberto Davalos
Answered by attorney Carlos Humberto Davalos (Unclaimed Profile)
DUI/DWI lawyer at The Law Offices of Carlos H. Davalos
File a petition to rescind to get his license back. No penalty for refusing a portable breathalyzer but you get a license suspension for refusing the one at the station. The fact that he passed the HGN test bodes well for his defense.

He is facing another felony charge and an additional allegation of a prior prison term. Could be 4 years top with other prison priors adding an additional year each.
