What will happen with the probation when I go to court?

The new ticket is a violation of probation. More importantly, does your probation prohibit you from drinking? If it does, I would expect the judge to jail you.

How should I plead to my first DUI?

Answered by attorney Craig W Elhart (Unclaimed Profile)
DUI/DWI lawyer at Craig W. Elhart, PC
Because your bac was 0.17 or above, you could be charged under Michigan's new super drunk law. At the arraignment, you should plead not guilty and hopefully at the pre-trial the prosecutor would allow you to plead to OWI without the enhanced penalties of the super drunk law. You could also ask for a court appointed attorney to assist you.

What should happen if a police officer doesn't read you your Miranda rights before placing you under arrest for a DWI?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.
