You can refuse a breath test as many times as you want. The problem is IF you do not request an ALS hearing or get convicted, your license will be suspended for a longer period of time.

There may have been a first appearance hold. It's not right, but sometimes jails will put a hold on someone so they be seen by the judge first. Assuming he doesn't have anything else holding him (violation of probation or another case) then he should be able to bond out today.

Assuming you are in California, usually everything relating to sentencing has to be finished before probation ends. If the facts are, as you have related, the court has no jurisdiction over you if probation has ended, you may have a new problem depending on how you ended up in "detox" but if you have completed probation then you can't have a problem with the earlier case.
