First of all, do not rely on the legal advice of a lawyer who represents a party with adverse interests to you. In Wisconsin maintenance (+spousal support or alimony) is almost always addressed as part of the Marital Settlement Agreement in a divorce. And you must be certain that is done in your case. Otherwise in a later action you bring for support, you will likely be told that that ship left the port already, since the divorce judgment settled all issues between the parties. Do not let yourself be led astray. If your spouse has a lawyer like this one, you need your own (more ethical or better informed) lawyer.

Your husband can file for divorce in New York and make the claim she took the child against his consent and has refused any contact. You need to hire an attorney in New York, the fact they are not divorced is in his favor as far as getting the child back, what she has done could be considered parental abduction and aside from filing criminal charges taking the child from her is a remedy courts often order.

If the house was in your separate name, it is still your house. The question is whether the community has any interest in the house - principal pay down and an proportionate interest in any increase in equity. Best left to an attorney to advise you. If you put his name on the house, he can try to force it sold. See an attorney.
