Your husband doesn't need to sign the papers (although it would make things easier if he did). I don't know if you are referring to the initial papers (Summons and Petition) or something like a Marital Settlement Agreement.

I agree that this is unfair to you and it is also uncommon for a judge to make this type of ruling. You should contact a local family law attorney to attempt to modify the previous court order.

You may be able to ask the court to hold him in contempt and return whatever money is left into his retirement account. There is generally in Idaho a standard order that neither party can take assets out of the community once the case has been filed. If he didnt ask for permission, then he could be violating that order.
