Can i get an annulment?

Sarah B. Russo
Answered by attorney Sarah B. Russo (Unclaimed Profile)
Divorce lawyer at Law Offices of Russo Prince
What do you believe your grounds are for an annulment? California only permits an annulment for a few very specific reasons, such as fraud or incapacity.  If your spouse was UNABLE to consummate the marriage that might work, but physical distance alone is unlikely to be enough. I would suggest that you meet with an attorney in person to discuss your case and determine how best to proceed.  In any case you would be entitled to a divorce and that might be the better option.  Good luck to you.

Will i be given any thing at all if I'm guilty of adultery and a stay at home mom?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
Adultery does not matter in California because it is a no fault divorce state. You are entitled to one-half of all assets acquired during your marriage. You are responsible for any debts in existence on the date of your separation if they were incurred during your marriage. You are entitled to spousal support and some assistance with attorney fees. See a family law attorney in your community for more particulars.

If my wife will not sign the final divorce papers in due time, what is my recourse?

Answered by attorney Anita Alice Webster (Unclaimed Profile)
Divorce lawyer at Law Offices of Webster & Associates
If she will not sign the paperwork for an uncontested divorce, then the case is contested and you have to proceed to court. Talk to your attorney or an attorney about how best to proceed.
