Can my husband keep me from entering our house?

You don't have a key? You have the right to possession just as much as he does. But legally, you could always sue to get back in or, probably better, file for divorce and take your half of the house.

Is the opinion of the child ever taken into consideration in a divorce? How?

If you mean the child's opinion about where he wants to live, it can only be taken into consideration if a guardian ad litem is appointed who then weighs the child's opinion based on his age, maturity, intelligence etc.

How do we go about the divorce if we live in different states?

Answered by attorney Barbara Peyton (Unclaimed Profile)

You file where you are a resident. Your state will have procedures for serving the other side in the other state. The other side will then have the opportunity to respond in your state. A good paralegal can probably help you with this. Good luck.
