What is our option for a B1/B2 Visa Change/Adjust Status?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
What determines how long you can stay in the U.S. is the expiration date on your I-94, not the expiration of your visa. If you are still in status (your I-94 has not expired), then you may be able to change your status to a E2 (Treaty Investor) depending on what country you are from and how much you invested in the new business. Also, if the amount of investment exceeds $1 million (or $500,000.00 in some locations), you may be able to file for a EB-5 (Investor) Green Card. Given the circumstances you describe you should speak to an immigration attorney.

Is it faster if I filed my father's adjustment of status in the USA or in Mexico?

It is easier and quicker if he files for adjustment of status while in the US. Just consult with an experienced immigration lawyer before applying.

You definitely need a lawyer in this situation. Perhaps you could be eligible for VAWA relief (violence against women act), but you have to sit down with an attorney to determine that. I do not believe that you can successfully handle this situation without legal help, unfortunately. You could try contacting the Northwest Immigrants' Rights Project for free legal help, but they do not accept every single case because their resources are limited.
