Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. How did he enter the U.S. Did he enter with a visa or without inspection? What was the misdemeanor charge. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your husband's situation. (S)he would then be in a better position to analyze his case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is properly presented so as not to delay the process.

Can my wife of 12 years stop my appeal for my green card by divorcing me?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If your green card application is based on your wife's petition then her cooperation is required. You may have other options for permanent residency through an employer or in some case as a self-petitioner. Contact my office to schedule a consultation and discuss fees and procedures.

Will the age difference affect my petition for permanent residency?

Answered by attorney Jennifer Maude Oltarsh
Immigration lawyer at Oltarsh & Associates, P.C.
An age difference may be considered an indicator of the good faith of the marriage. I would suggest professing substantial materials to overcome any negative element.
