Assuming 1) you are ready to and get married; 2) there is only one deportation; 3) no illegal entry after the deportation; and deportation was not for a serious crime THEN as the spouse of a U.S. citizen he would benefit from your petition. He will need a waiver in addition to the normal paperwork for an immigrant visa. You need to get an adjustment file ready. Have an attorney find out if the NTA has been filed with the court yet, and that will determine how it can be filed.

Whether he will be protected depend on how his Dad obtained residence. If he leaves he will be subject to a 10 year bar and will need a waiver. I strongly urge you to retain a lawyer before you proceed.
