I am a permant resedent I just recieved secound DUI, can it lead to deportation?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
Having one or more DUIs can result in your losing your Green Card. Since the immigrant laws are applied differently in different parts of the country, how it will affect you depends on where you live. You should consult with an experience immigration attorney in your area. You should do so before you pleading to any DUI charge. Also, more than one DUI can result in you being denied re-entry to the U.S. if you leave the US on a trip. Another reason to speak to an immigration attorney.

I am in the middle of the Naturalization process. Can I leave the country on 5 day cruise

Answered by attorney Doreen A. Emenike

Hello,   You can travel while your naturalization application is pending however at the interview you would need to let the USCIS officer know of this trip abroad. As is it a very short trip it should not affect your application unless you have traveled abroad for at least half of the past 5 years (or 3 years if your naturalization is based on your current marriage to a US citizen). If you have traveled outside of the country so much, it would be a good idea for you to calculate the number of days you were abroad and speak to an experienced immigration lawyer to be certain that your trips would not cause you any problems with your application. Good Luck. The information above is of a general nature and is not, nor is it intended to be legal advice. For specific legal advice about your situation, please speak to your immigration attorney.

How could we get an adjustment of status?

I am assuming that you are a U.S. citizen. Once you are married, you would file an I-130 and I-485 to get the process started. Your fiance's deferred action will not affect the immigration process. I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is presented so as not to delay the process.
