Is my wife's Facebook sexual activities constitutes to a divorce?

It depends upon whether she failed to meet her responsibilities as a wife and mother (if there are children). Whether she gets maintenance depends upon whether she can support herself.

How do I serve my husband the divorce papers if he is in prison in another state?

Answered by attorney David Ari Goldberg
Divorce lawyer at The Goldberg Legal Group
You may want to contact the sheriff or the authority that runs the prison to see what options they have available to you in order to have your husband served. You may also want to consider hiring a process server in the local area to help you out. You would need to serve the Summons, Petition for Dissolution, UCCJEA (if there are children), and any other local forms that were filed with the court to initiate the divorce.

Will my divorce be granted even if she doesn’t respond at all?

Barbara Kay Hammers
Answered by attorney Barbara Kay Hammers (Unclaimed Profile)
Divorce lawyer at Hammers & Baltazar, LLP
She doesn't have to "accept" it. Anyone over the age of 18 and not a party (you or your wife) can serve her with the papers. If she refuses to take them, they can be dropped at her feet as long as she is told it is "legal process."
