My sister and I were Co-Personal Representatives for our Mother's estate which had 12 siblings/heirs. We consulted with Daniel J. Monte, who is a trust and estate attorney with almost 30 years experience. He thoroughly reviewed our Mother's Will and Codicils, then met with us by Zoom to answer a number of questions we had about probating the estate. Most importantly, he explained that there is a real and legal distinction between real property (our Mother's house/lot which was now legally owned by one of the siblings) and personal property, which is the contents of the home (furniture, jewelry, personal effects, collectibles, etc.). This was a new understanding by the siblings/heirs which dramatically changed how we as Co-Personal Representatives probated the estate. He wrote a 4-page letter to the 12 siblings/heirs detailing his answers to all the questions we raised during our consultation with him, so that the whole family had clear legal guidance for our work.
My brother and I appreciated working with Ms. Baysinger on a care related issue for our mom with Alzheimer’s. It was a tricky question: how previous planning in another state may/may not transfer to NM. Ms. Baysinger was professional and clear, and followed up with additional information after consulting with peers. I highly recommend Ms. Baysinger and the firm.
Our first attorney advised us not to continue to find answers to 5 questions for our deceased mother’s estate. This attorney felt it wasn’t worth the time/cost. We then began searching for an attorney who is knowledgeable not only handling Wills & Trusts but knowledgeable in Probate for our deceased adult brother who had “special needs,” & who was part of the original Will as well as having his own Trust. This seemed complicated & I thought we’d end up having 2 separate attorneys until we were recommended to Ms Graham. She was our God’s Blessing along with the office staff.
