You will have to wait till he receives a divorce. That being said if divorce is going to take long he can file for a dissolution of "status" only so that he may enter into the marriage with you. The fact that he is divorcing his wife is irrelevant since he is a citizen and can apply for you so long as you are entering into a good faith marriage.

You should answer every question on the Petition honestly. There have been instances where, as a result of Petitions filed with the California Service Center, they have gone out and picked up the beneficiary, but it has been a few years since I have heard of that occurring.

If properly processed it takes 7-12 months from the time the petition is filed until the foreign spouse receives their immigrant visa interview. You should be receiving a decision on the I-130 petition soon. Then the file will be sent to the NVC to begin the immigration visa process.
