Do I need to have the copy of the i140 to be eligible for the i140 or can I use the receipt?

Immigration lawyer at Havens Lichtenberg PLLC
To prove your 245(i) eligibility, you do not need a copy of I-140 - the filing receipt should suffice. A copy of the labor certification application (that must have been filed and approved before your father's employer could have filed I-140 petition) would be helpful, and your attorney should be able to obtain it from USCIS or from the department of labor of the state where it was filed.

How will I get my spouse and 2 month old baby to the US?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
More information is needed. You have a complicated situation that really needs to be answered in detail at an appointment with a competent and experienced immigration attorney soon. Additional action may be needed with the State Department to insure that your son timely enters the U. S. within six months of his birth. Good luck.

Can I fix my parents' papers if I just turned 21?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Yes they would be considered immediate relatives if you are a U.S. citizen over 21. Are they in or out of the U.s.? did they come with or without papers if yes? Lots of questions I will need answered to advise their eligibility and where they will need to apply.
