Will I be deported because I overstayed with my visa?

Matthew Ian Bernstein
Answered by attorney Matthew Ian Bernstein (Unclaimed Profile)
Immigration lawyer at Simvisa
If you entered the United States legally, with a passport, and have proof of legal entry (the "white card" in your passport) you should be able to adjust status to permanent residency based on marriage to a US citizen, without leaving the United States.

What will my status be if I marry my girlfriend?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You have no legal status by virtue of marrying your girlfriend. Once married she has to file an petition for you, and once she is a U.S. Citizen you have to apply for a Green Card. If your girlfriend becomes a U.S. Citizen you can remain in the U.S. after your B2 status expires and apply for your Green Card in the U.S.. If she does not become a U.S. Citizen, then you will have to depart the U.S.

Can I start the permanent residence process for my wife while she is in the US on a tourist visa?

Immigration lawyer at Law Offices of Nicklaus Misiti, PLLC
In order to enter on a visitor's visa your wife must not intend to stay in the United States. There is a strong chance your spouse will not be allowed to enter the US. If she is allowed to enter you may be able to petition for her. I would recommend you speak with and retain an immigration attorney. For a free consultation you may contact my office.
