Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Yes if you decide you want a divorce then retain a divorce lawyer. However, if the marriage can be saved and you wish to proceed to sponsor your spouse for his green card, then retain an Immigration lawyer here in Florida.

If you are a US Citizen, and if you have met your fiance in person, then you can apply for a fiance visa for him and get married within 90 days of his arrival into the US. Of course you need to be legally divorced from your first husband before applying. It takes a little less than 1 year to obtain a fiance K visa, so you should act as soon as possible. Also, because you may not qualify as a financial sponsor due to your situation, you can have someone else act your joint financial sponsor. You should retain the services of counsel here in Florida to assist you. Good luck.

Can a US citizen get deported from the US?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Although the time for getting help from an immigration attorney should have been at the moment you learned that ICE sought to remove/deport you, you still should be able to get relief. A U.S. Citizen is not subject to removal/deportation, although in some instances, such as where fraud it alleged to have taken place in the naturalization process, a U.S. Citizen may be subjected to a formal denaturalization process. My firm's practice is exclusively immigration law, but does not include the type of immigration issues you raised.
