Hello. You can file an I-539 to change, however, you may go to school on an H4. You do not need to change to an F1.

Since you are both legally adults, you qualify for a fiancé visa.  Your prior stay in the US won't affect your application.  I recommend hiring an attorney but I'm biased because I am such an attorney!

As the crime with which you are being charged is a misdemeanor in which the maximum jail time is one year, and this is not the type of offense which can be construed to be an aggravated felony if you are sentenced to one year, you are not deportable if convicted.
