If a mother enters with a visa and her adult USA citizen child sponsors her, normally she would not need to leave.

The answer to your question depends on (1), where, when and how the drug charges were resolved, (2), on what your status is (i.e. US Citizen or LPR), and (3) whether your husband can resolve his case in the US, and if not, whether you are both willing to take the risk of going overseas to resolve it.
