Your employer is not required by law to give you a complete copy of the I-797A approval sheet of your H-1B. However, he is supposed to give you the entire lower portion with both the left and the right sides. The right side is the I-94 (as you know), and the left side identifies the petitioner and the validity date of the H-1B. According to the legend on the I-797A, the employer should keep the upper portion of the form and the lower portion should be given to the worker. The right side should be with the I-94 arrival – departure record; the left side can be used in applying for a new visa. We would need to know more details about why he was deported - criminal matter, overstay, fraud. Then he or both of you should call to set up a consultation on his options Make sure he does not sneak back in as that will great reduce or eliminate his options.
