How can my case be evaluated if the person entered the US illegally and has committed 2 felonies?

Alan Rodolfo Diamante

His old conviction can be deemed an aggravated felony thus making ineligible for various defenses. If he left under voluntary departure and not deportation, he might be able to bond out of immigration detention since he was convicted before 1998. It is worth showing the conviction and immigration documents to a skilled attorney.

As a general rule, a foreign national who enters the United States without inspection is not eligible to file an Application for Adjustment of Status (Form I-485). He would probably need to depart from this country and pick up his immigrant visa at a US consulate.

What are the effects in my CR1 visa if I didn’t want to come to the US in more than 6 months?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
This will not have any effect on your Residency. However, it may delay qualifications for citizenship. You can always overcome this issue by staying in the US longer in the future. Or, you can show the reason you stayed longer than 6 months (and less than 12).
