Does my H1b visa gets cancelled if I go for F4 green card visa and the green card visa is denied?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
The H1b visa has "dual intent". This means you can have the temporary intent to resume work for your employer and have permanent intent to want to stay in the US as a Resident/green card. Thus, they should not cancel your H1b.  Since you are single, it should be fine. You may want to do your own search of marital records in your city and provide proof that you are not married if they ask about that. This of course, will depend on where you live. Good Luck!

Immigration lawyer at U.S. Immigration Law Group, LLP
It will depend on how long the petition was pending before it was approved. You may be able to deduct this amount of time from your current age to determine whether you can process with your mother under the Child Status Protection Act.

What is the process for a visa waiver?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
My guess is that you have an immigration attorney representing you. I encourage you to fully discuss with him or her, as they will have the full facts of your case. Leaving the US generally does complicate your ability to return and often does require filing of an extreme hardship waiver, which is difficult to obtain.
