What should I do to maintain my f1 status on my visa?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. I am not sure what form you filed. Can you double check? If you filed an I-539 to change to a dependent on your husband's H1b, then you are changing to an H4. Is that correct? Or, did your husband file for his green card based on work and you both filed an I-485. If that is true, then, you are now in "adjustment" and need not maintain your F1.

Will the green card be denied if I am 56 and my fiance is 25?

A big age gap is not a ground for denial. Be prepared to shore up sufficient documentation establishing that you have a legitimate relationship, you intend to live together as husband and wife, and that you are not entering into the marriage for the sole purpose of obtaining a green card.

What can I do if I overstated on my ESTA (Travel Authorization) but my mother is a US citizen?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
Your mother can petition for you on form I-130, but you will not be able to adjust your status to that of a lawful permanent resident when your priority date becomes current unless you have been grandfathered under INA 245(i).
