How long do I have to wait in order to be able to apply for citizenship? Or can I do it now? Will my DUI conviction cause my application to be denied?

Depending on the dates, you may qualify for derivative citizenship where the DUI would have no bearing.

Question about US visa

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The question for an immigration inspector is whether your mother-in-law is able to show that her stay is temporary as she is here under a visitor visa. Trying to make a quick return to the US after being here for six months might cause a problem at the port of entry. After leaving the US, a visitor should stay outside the US for an appreciable period of time before returning. Your mother-in-law may in the alternative file for an extension of stay with USCIS. Can you enter back to the United States after you have completed probation?

Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)
Immigration lawyer at Law Offices of Alan R. Diamante APLC
If his only offense is DUI or DWI, he should not have any problems returning from a brief trip. However, he must not violate probation because if he does, he risks an arrest warrant and that can cause him to be detained upon his return.
