Would i qualify for a green card?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You are allowed to attempt different avenues of immigration. The difficulty may be that you will not be qualified to adjust status to permanent residence in the country since you are already out of status. While there is an exemption that allows immediate relatives of US citizens to adjust status without leaving the country if they have overstayed, that exemption does not apply to the immediate relatives of permanent residents. If you have not been out of status for more than 180 days, you may decide to leave at this point after marrying your girlfriend who would then apply for your residence status which you could ultimately obtain after interview at the American consulate or embassy in your home country.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. WHAT EFFECT WILL MARRYING SOMEONE WITH A GREEN CARD HAVE IF I JUST GOT A DIVORCE?

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
You could get married but you could not stay in the United States because marriage to a lawful permanent resident requires application for a visa that is numerically limited, and thus there is a wait involved in obtaining an immigrant visa based on such marriage.  Right now that wait is just over two years.

N 400

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
I believe that you have misread the form. There is nothing in the law that requires a person like you to be married to a US citizen spouse before filing the N-400 application unless you are attempting to file under the three year instead of five year rule for citizenship. If filing under the five-year rule, you should be able to file for naturalization as long as you are not barred by any of the grounds outlined in the application questions.
