It is very doubtful that there is any way for him to avoid deportation. Any charge of drug possession over 30 grams of marijuana results in an aggravated felony finding and a lifetime bar from the U.S. It may be helpful to arrange through us or another immigration lawyer of your choice for him to fly to a city in Mexico other that a border city to avoid some of the risk. Generally they send a Request for Evidence and allow a late submission. However, if they choose, they could deny the case for failure to include it.

You would mark married, because you are still legally married. If you are applying for naturalization on the basis of that marriage, then you should consult with an attorney as the marriage must be viable.
