What is the process of filing a fiancee visa application for a spouse?

Answered by attorney David L. Leon
Immigration lawyer at David L. Leon, P.C.
For starters, the processes are different for fiancees vs spouses. Are you married at this time? Also, where is your fiancee / spouse? In the USA? Or abroad? If your mate is in the USA, how did s/he enter the country? With inspection or without? Any criminal history?

What's faster, employment based or family based petition?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. You cannot file a concurrent I-130 & I-485 for a brother. The I-130 visa number must first be available. That will take 12 years. It is likely the EB category will be faster, but that will depend on the job requirements and his nationality.

Can I sue a residency program?

Answered by attorney Kenneth G. Wincorn
Immigration lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
It is doubtful that it would be practical. In the U.S. anyone can sue but success is not likely and the cost high.
