You cannot apply for a work permit on the mere basis that your I-130 petition has been approved, unless you are eligible under some other category.

As long as a person has a valid, unexpired visa to enter the USA, they will normally be re-admitted, as long as they are not otherwise excludable. Sometimes, H-1B workers will bring along proof of current employment like recent pay stubs, last year's W-2 etc.
