Permit of 1 month aplied for extension b2 I am pregnant and to give cs exam but at airport CBP officer strongly asked abt pregnancy and I denied

Answered by attorney Alan Lee

I believe that your chances of obtaining an extension of your B-2 status are likely okay. You were admitted by the CBP officer instead of being turned away and so unless the officer marked your passport with remarks like no change of status ("no C/S") or no extension of status ("No EOS"), you would most likely be treated as a fresh adjudication by a U.S.C.I.S. officer.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can he come here, spend time with me and then marry me, if it works out?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
From my perspective, he could. Certain immigration agents might say no, but as a practical matter, if he gets into the country as a visitor and you later get married, that's a very normal immigration scenario.

Can my U.S. citizen husband apply for an Immigrant visa for me if he is in prison and on death row?

Assuming the marriage has been consummated, their is no law prohibiting a death row inmate from filing a visa petition. That's not to say it would be approved, but he certainly can file.
