It can take a bit of time, perhaps a year, for your Mom to lawfully immigrate. However, if the paperwork and supporting documents are questioned, it may take longer and even be denied. There are two or three phases in the process. The first with USCIS, followed by a second phase of forms with the State Department's National Visa Center, and a third step with an interview and medical at or in the City of the Consulate or Embassy. If denied, you can lose at least $420 in filing fees, perhaps more, when you pay the State Department.

In order for you boyfriend to be able to immigrant with you to the U.S. you must get married before you enter the U.S. with your EB-1 immigrant visa. Preferably, you should get married before your EB-1 immigrant visa interview. If you enter the U.S. and become a LPR before you are married, you will have to separately petition your husband and it will take approximately 5 years for him to immigrant to the U.S.
