Is it OK to send both applications together for i-130 and i-485 when I'm without status in US or should I get an attorney?

Answered by attorney Lana Vladimirovna Kurilova Rich (Unclaimed Profile)

You should file both forms (and all applicable additional forms and supporting documents) all together as one comprehensive package. Your overstay does not matter for this process; so long as you have no criminal history, and so long as your marriage is genuine, you should be able to adjust your status.

As long as you submitted the application for change of status before your visitor status expired, you are permitted to remain in the US legally while the application is still pending.

Should I get married in the US or Mexico?

Answered by attorney Jennifer Maude Oltarsh
Immigration lawyer at Oltarsh & Associates, P.C.
If your boyfriend is in the US you should marry here. His departure may trigger a bar from returning. Obama has made a rule change to help such families. He may need a waiver. I would suggest finding an attorney.
