Will I receive jail time if I got 2 DUI's in 2008 and now one in 2012?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
It depends....some counties in California require jail time on a first offense DUI. If MS is priorable here in CA, then DA could charge as a 3rd offense which would be a mandatory minimum 120 days in jail.

Will this bench warrant show up in a different state?

You have plenty of options without returning to the state. But each option includes retaining an attorney to appear on your behalf because you are unable to without the additional travel costs. So my advice is to contact an attorney such as myself for a free consultation. I wish you the best.

You can no longer simply pay the fine. To handle a warrant, you must turn yourself in to the issuing court, with or without an attorney. You'll try to negotiate a recall of the warrant[s] and negotiate a plea bargain on any Failure to Appear charge. You'll try to negotiate bail reduction or OR release. You'll try to negotiate a plea bargain or take to trial the outstanding charge that caused the warrant. On misdemeanors and infractions, your attorney can appear in court without the defendant being present. Effective plea-bargaining, using whatever legal defenses, facts and sympathies there may be, could possibly keep you out of jail, or at least dramatically reduce it. Unless you're competent to effectively represent yourself in court against a professional prosecutor trying to put you in jail, most people hire an attorney who can.
