It means you need to fight this case. As I understand it, you were on the sidewalk, discussed some issues with the police, and walked away when you were done with the conversation. In order for a district attorney to prove you were drunk in public, they must prove you were "so intoxicated you could not care for yourself or your safety". This is obviously not the case here, and the police were just making empty threats. If you actually are charged with being drunk in public, contact a local attorney immediately and fight this case.

You are under 21 and not allowed to drink alcohol at all. There is a zero tolerance policy in California and most other states where you can be convicted with any trace of alcohol in your system.

Any misdemeanor has a one year statute of limitations from the discovery of the crime. It probably and logically runs from the date of the collision and injury for purposes of any criminal prosecution, plus, the prosecutor would already have filed if they intended to. But DMV could possibly argue it runs from their learning of the BA level as to their normal DUI based license suspension. I don't think so, but there are no guaranteed answers. You'll have to make your own decision /best guess, and live with the consequences. You'd always have appeal rights as to Department of Motor Vehicles actions.
