Could I be arrested for DUI if I was sleeping in my car? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
You may very well have a defense. IF the car was not running, then you were not driving. You might have said something too much to the arresting officer, of course, and he may have had some kind of tip-off in advance. What you should do is consult a lawyer experienced in DUI defense very soon. Good Luck.

What should I plead and what are the consequences for the plea for a first offense DUI of marijuana?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
If you were not high at the time, you should not plea guilty - these cases can be won at trial the blood test is relatively meaningless for a heavy MMJ patient a plea of guilty to DUI will get your license suspended, but if it is a plea to DWAI-1st, then no.

Can I be charged with 23152(b) if I refuse the BAC tests?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
I would need to know more facts; however, the prosecutor can introduce into evidence the fact that you refused the tests. If the judge or jury hears that, how do you think they will interpret that? You say you were "super wasted". That may be enough (especially if there is a video) to have you convicted, even without the test results.
