Can I be convicted of a DUI?

You have a "no control" defense to the charge of DUI. You have to be in actual physical control of the vehicle and intoxicated in order to be prosecuted for DUI. If you plead guilty, you will have a permanent conviction on your criminal record in Colorado, as well as have to pay thousands of dollars in court costs and fines. Contact a Colorado Criminal Defense or Colorado DUI Defense attorney as soon as possible. You may also need to request a DMV hearing in order to preserve your driving privilege.

The DMV typically has a hearing to determine the length of revocation and the reinstatement requirements. The interlock requirements vary depending on certain circumstances like your BAC and prior driving record.

What does it mean in the long run if my son was arrested for DUI, spent the night in jail and told by the judge the next morning that no charges were

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
That is good news. If they never file charges, be very happy. If you want to check on his record, wait about a week or so and go to the Colorado Bureau of Investigation on-line, you can request a criminal record for less than $10.
