In Colorado, depending on the facts of your case, you could be charged with DUI or DWAI. If charged with either, you should immediately consult with a DUI attorney in your area. There could be DMV consequences that must be addressed, regardless of what criminal charges are filed.

The penalty for driving while your license is suspended for OUI offense is 60 days in jail, without exceptions. I STRONGLY suggest you get a good lawyer who practices in the court where you are charged with the operating after charge. I have certainly won quite a few of these cases, but they are very difficult to overcome. The statute is tight and specific and allows no alternatives to 60 days committed.

The criminal case - which is what was dismissed - and the DMV/ driver's license issues are two different things, handled by two different authorities, and can come to two different decisions. If you did not request a hearing on the revocation of your driver's license, or if you requested a hearing and lost the hearing, then the dismissal of the case in court does not impact that. Therefore you must do what DMV is requiring in order to legally drive.  A lawyer coudl analyze your drivintg record and the facts of your situatiopn to give more specific advise, if you made an appointmtne and sat down with a lawyer.
