Only courts can convict you. The DMV may have assessed points or some other sanction for being charged, but that is not the same as a criminal conviction. J

How much time will I spend in jail for a first extreme DUI if I have a very clean record?

Not sure what you mean by "extreme" DUI. Injuries? It's a felony and you'll do some custody time, depending on the seriousness of the injuries. No injuries but a high blood alcohol level? In some counties you'll do 10 days in jail. In others, none. In others, 30. It depends on what the local practice is. There's no statutory requirement for jail time even if a high b.a. enhancement is alleged.

You can still be charged with a DUI under the portion of the statute that prohibits operating a motor vehicle on the public highways while under the influence of alcohol to the extent that you could not operate the vehicle safely. At trial the officer will present other evidence, driving erratically, smelled of alcohol, blood shot eyes, slurred speech etc. It is not necessary to have a blood alcohol content to prove a DUI. Additionally, in Alabama if you do not submit to the Draeger, you will have to have an ignition interlock device installed on your vehicle in order to get your driver license back.
