What will happen if I did not complete remaining community service by termination court date?

Answered by attorney John F Brennan (Unclaimed Profile)
DUI/DWI lawyer at Musilli Brennan Associates, PLLC
You will have to complete your community service, ask for an extension - do the service. Hopefully the only result will be the delay in closing your case.

What am I facing for OUI with 10 points and priors 20 years ago?

Answered by attorney Richard David Peacock (Unclaimed Profile)
DUI/DWI lawyer at Peacock Law Group of the Lowcountry, LLC
In SC, if you already currently have 10 points on your license and you submitted to the breathalyzer and blew 0.115, chances are that law enforcement will not agree to plead this out to reckless if you are not represented by counsel. Even if you are represented by counsel, you will likely need to get it plead down to something less than reckless driving prior to pleading guilty to any traffic offense. The reason for this is that Reckless Driving is a 6 point offense. That would take you up to 16 points which, I believe (without looking it up), is the point at which your license is suspended in South Carolina due to the amount of points. Now, there are other options available that could reduce your points prior to any negotiation of a plea which could take your total points down below 16 anyway. In addition, if you are convicted of a DUI that is an automatic suspension of your license for 6 months (if it is a first offense conviction) or more dependent on the number of previous convictions within the last ten (10) years. You should consult in person with a local attorney as soon as possible regarding these matters. I do hereby clearly advise against any reliance on this information as advice or the application of it to a specific situation without a more thorough consultation with counsel.

If I am drunk can my unlicensed husband drive?

Answered by attorney William R. Pelger
DUI/DWI lawyer at Pelger Law
The fact that your were drunk is not a defense for another person, who is unlicensed to drive. He may be charged with driving without a license. I am not sure, but you may be charged if he has not license due to a suspension or revocation.
