How long from the time papers were filed until husband is served?

Peter David Ticktin
Answered by attorney Peter David Ticktin (Unclaimed Profile)
Divorce lawyer at The Ticktin Law Group
The time of service depends on whether your husband tries to avoid service. A process server will attempt to serve your husband on the address listed on the Summons. Sometimes they will be able to perfect service, which means they have given your husband the Divorce papers, on the first try. Sometimes it can take weeks. If your husband does try to evade service, by hiding or refusing to open the door, the Clerk upon an Affidavit of Due Diligence will issue a Notice of Action for Publication. Good Luck.

What do I do now to proceed with the divorce since she hasn't answered the petition and it's been almost 2 months?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
If she has been formally served with the petition, you are entitled to enter a judgment on day 61 or thereafter. If she has not been formally served, you need to have that happen.
