You cannot prevent a divorce from being granted if that is what one side wants. Your goal should be to get everything you are entitled to receive (spousal support, half the assets, etc.). A good attorney can help you through this process.

How you get divorced is by filing a petition for dissolution of marriage. You have to at least attempt to have her served properly with a copy of the petition and a summons, and you have to make diligent search and inquiry about what you have done to try to locate her. The best thing to do is hire an attorney for this matter. If it can be done, you have to publish in a local newspaper a notice. Then you can get divorced.

You do not indicate where you and your husband lived when you were still living together, which may be important in determining whether the FL court has jurisdiction to grant any relief other than dissolving the bonds of marriage between you. You also don't indicate why you never pursued a divorce, child support contribution, or other relief before now. You have to be careful that any response you file does not unintentionally submit you to the jurisdiction of the FL court for purposes other than just dissolving the bonds of marriage, assuming that the FL court doesn't already have such jurisdiction. Due to differences in the law between FL and NY, there may potentially be a benefit to having financial and property issues determined in one state over the other. You need to consult with attorneys in both FL and NY to determine where and how best to proceed. You should act quickly, as you generally have only 20 days from when you were served with the papers to file a response in FL.
