Can I kick wife from inherited home during divorce?

You cannot kick your wife out of the martial home.  You will have to seek an order from the Court and ask the judge for exclusive use and possession of the home.  Since you inherited the home and are the sole owner, you should make a claim in the divorce action to be awarded the home as your sole and separate property.  Courts don't usually make decisions on who owns property until the final hearing, but can make a temporary order for exclusive use of the property pending the final hearing.  You did not mention whether your wife had been violent or abusive toward you but if there has been domestic violence you could seek an injunction, which would if granted, remove your wife from the property. What I have found during 20 years of handling divorce cases is that the best way to get someone out of your house is to help them leave. This may mean paying for first and last months rent and utility deposits for your wife, and helping her move her belongings to her new apartment.  If your wife has no place to live and no means to leave, it will be difficult for her to leave, and a judge probably wont throw her out if she has no place to go. Some times you get farther with a carrot than a stick.
