What happens if I mark on my response to divorce summons that I do not feel our marriage is broken?

Divorce lawyer at Mark A. Manning, P.C.
You need to file an Answer to the Complaint for Divorce within the time proscribed (usually 21 days if service was made personally or 28 days if made by mail) in order not to be placed in Default. If in your answer you believe the marriage can be preserved, then your attorney in filing your answer should say so. It won't "stop" the divorce in and of itself, but it protects your interest and communicates in writing what you may be saying to each other, thereby avoiding more miscommunication.

I need a quadro to transfer from my 401k to my wifes IRA in the divorce. I'm in Kent County Michigan. Who can do it and how much?

Divorce lawyer at The Law Offices of Monica Wilson, PLLC
You will need to know the plan information for the 401k you are transferring the money from. The QDRO is a court order that allows the money to be transferred without the usual penalties that are usually associated with early withdraws. My office does prepare these, and would be happy to help. Monica

How could we finalize a divorce if my spouse is in jail?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
First things first: hire a lawyer. It's almost worth the investment to help you overcome difficulties like the one you mention. It is extremely unlikely that a divorce is held open for 5 years. In most counties in Wisconsin, if there is no movement in a case for a year, the judge proposes to dismiss the case, and gives the parties a specific time within which to act, or else the case will be dismissed. That your husband is in jail is not a very serious obstacle: he can waive his right to appear, or in many courts he can appear by a television feed. A good lawyer will help a lot.
