The length of the marriage is one of the considerations in determining spousal support. Retirement and other property accumulated during the marriage has only a small bearing on the determination of spousal support while the divorce is pending. Anything earned/acquired during the marriage (including retirement since that is earnings in another form) is community property and will be divided.

If your prior petition was dismissed, then you are not divorced. If you meet residency requirements in the State that you currently reside, then it may be possible for you to file there. You should consult with an attorney in order to determine what State has jurisdiction over your divorce matter, as well as any issues pertaining to minor children, if you have them.

You should consult with an experienced family law attorney in your area. Generally speaking the court will find him in contempt for failing to pay, enter a judgment against him, and could possibly order him jailed until he pays what is called a purge payment. This is, of course, not as easy or quickly done as you would like.
