In Wisconsin, everything is considered marital in a divorce situation until or unless a court rules otherwise. To get it ruled otherwise, it needs to be inherited property that was kept separate from marital funds...ie nothing paid out of the marital funds, not comingled etc. This is way too difficult a question to answer without review all the documentation and fully assessing the situation. Your dad needs to sit down with a lawyer asap if he wants to sell; however, if they are not getting a divorce and his name is on the business, it is possible it can be done but again it is too hard to know from the limited facts presented.

Divorce is separate from property but they post notice and it will not stop you from getting divorce. Property may be more difficult if he doesn't cooperate.

I'm not sure if you filed for Legal Separation or if you filed for Divorce/Dissolution. If you only filed for LS, then you need to re-file for Dissolution. If there is a Dissolution case pending and he refuses to settle, you can ask for a trial date and the Judge will decide the issues. You will probably need the help or an attorney to help you through this process, whether it is by default or a contested case, trials can be complicated for the lay person, and you want to make sure your interests are protected.
