What impact does his millionaire wife have on spousal support?

default-avatar
Answered by attorney Alfred Edwin Fahlen (Unclaimed Profile)
Divorce lawyer at Law Office of Edwin Fahlen
If your ex husband has a contract (prenuptial agreement) which covers some of his expenses that can be a factor to prove he has less need and more available funds to pay spousal support. Therefore his millionaire wife may be be able to be considered indirectly. You may may not just count her income to his current community for the purpose of spousal support findings. The real issue is whether or not your current support equates the lifestyle during your marriage to him. If not, then you MAY have a window of opportunity here to modify spousal support.

Am I liable for my spouse's healthcare costs after the divorce if we were married for at least 10 years?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
No. The ten year rule has to do with Spousal Support. If the court still has jurisdiction over this issue, the fact that one party has an increased need for support, could be a factor in order new or increased spousal support.

How do you annul a separation?

Answered by attorney Madanmohan Singh Ahluwalia
Divorce lawyer at Ahluwalia Law Professional Corporation
A legal separation does not end a marriage or domestic partnership. You cannot marry or enter into a partnership with someone else if you are legally separated (and not divorced). A legal separation is for couples that do not want to get divorced but want to live apart and decide on money, property, and parenting issues. Couples sometimes prefer separation for religious reasons. In a legal separation case, you can ask the Judge for orders like child support, spousal support, partner support, custody and visitation, domestic violence restraining orders, or any other orders you can get with a divorce case. And that is all you have done. There is no process to annul a separation. You are still married. You should ask the lender to use common sense. Show proof of living together.
