Do I need a attorney present when i am being questioned by a detective for a Theft charge?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Absolutely. I would never talk to a police officer about an alleged crime without a lawyer protecting me. Reschedule with the cop. Or just stand him up.

What will happen if I was charged with a misdemeanor a years ago and still have not been convicted?

If you have a 3 year old case then surely you have a lawyer representing you?! Talk with your lawyer! Generally, I tell people that if they can, let sleeping dogs lie. There is no statute of limitations issue because the charge is filed so the statute is tolled. You could create a federal speedy trial issue (there is no right to speedy trial in state law) but you would have to demand a trial now, something that may not be in your best interest. As the case grows older, witnesses forget and move on in their lives. If you are not negatively affected, I would not stir the pot.

How much is a Wal-Mart restitution?

Cynthia Russell Henley

You were ticketed for a class C misdemeanor theft case - a charge involving moral turpitude. I hope you did NOT plead guilty and agree to pay a fine or this case will be on your record for the rest of your life. At worst, you want to get a deferred disposition - a reset with conditions that will lead to dismissal. You need to consult with a lawyer IMMEDIATELY. If the court is not a court of record and 10 days has not passed, you may be able to appeal and avoid the conviction.
