Is there a statue of limitations on a Class A Misdemeanor?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
There is a two year statute of limitations for filing a complaint in a misdemeanor. The practice in Dallas is to carry the case after filing for a number of years. Each County has a different practice. The state has a duty to make reasonable efforts to locate and arrest and it may be a defense that they took too long. If you have been at the same address and it is a published address you may be able to use this defense if you are arrested.

What am I looking at for a DUI and possession charge?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You should've already hired an attorney to fight the civil license suspension. But you absolutely need a lawyer for these criminal cases now. DUI and POM come with high fines, stigmas, and jail time. You need to hire the best lawyer you can afford to navigate you through the system without incurring much damage.

Can I carry a gun if I am on probation for a DUI misdemeanor charge?

Gregory Charles Graf

Most terms of probation include no possession of firearms. You need to check the written terms of probation or ask your PO. More importantly, do you have a permit to carry?
