Hi, I wanted to ask if I'm able to claim bankupcy with only owing maybe 15, 000 together in bills and credit card debt.

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
To answer your question, you meet the requirements.  However, you might do better answering the suit and trying to settle each debt.  $15,000 is not a lot of debt for a bankruptcy.  The legal fees and long term credit consequences might be more than you could pay in a settlement.

My wife co-signed for her mother on a bank credit card. Now married, my mother is filing bankruptcy. Will my wife be paying?

If your wife co-signed she is liable for the debts. The person filing bankruptcy extinguishes their liability, but the person who has liability who did not file bankruptcy retains that liability.

I stand to inherit from my parent’s estate. Will this affect my Ch. 13?

Chapter 13 Trustees require that you file an annual update during the life of your Plan. If your income goes way up or you pick up a bunch of property free and clear, it would need be reported. If you are in a 100% Plan, you can pay it off early. If you are not in a 100%, the Trustee may require you to pay in a minimum of 36 months or 60 months, based on whether your income is over the CMI test or not.
