If I passed away do my children still get my house if I never reaffirmed my loan if I am current and never been late on any payments?

I'm not sure what you mean by "reaffirming" a loan. Generally, a loan lasts until the loan is completely repaid. However, if you still owe money on the loan on your house at the time of your death, that loan must be repaid first, before your children can inherit. If you have no other assets, your executor may have to sell the house to pay off the loan. Your children would then only receive whatever is left of the selling price.

My wife co-signed for her mother on a bank credit card. Now married, my mother is filing bankruptcy. Will my wife be paying?

The co-signer is just as responsible as the signer. They probably will come after your wife. What you can do about it is ask for verification of the debt. Perhaps if they sue you could do what is known as a notice of production, asking for all of the individual receipts for credit card purchases. Most companies use to have central clearing houses where the receipts go. Who knows where they go now in this digital age. They may have to produce these things for trial. You will need to hire an attorney in order to do this right. Good luck.

Is there any reason filing a 3rd bankruptcy will not be granted?

Answered by attorney Rex K. Daines
Bankruptcy lawyer at OlsenDaines
There are several issues related to repeat filings. First is the timing of the filings. Cases filed soon after a prior case is dismissed have different rules related to the automatic stay. Also, a person is more likely have a bad-fait objection in a repeat filing. In addition, there may have been specific rulings in the first case that could impact a second or third case.
