Can I sell a house after the loan wasn't reaffirmed?

You can sell your house. You will pay the remaining balance of the loan at the closing. It doesn't matter all whether or not you reaffirmed the loan.

Can my debtor legally take every penny that I have in my possession leaving me nothing to live on?

Answered by attorney Marlin E. Branstetter
Bankruptcy lawyer at Marlin Branstetter Attorney at Law
In California a judgment creditor is able to levy your bank account a take all funds that are there to satisfy their judgment. You can file a claim of exemption with the court (You have a limited time to do this) and claim that some or all of the funds are necessary for the support of you or your dependents. Be prepared to document your expenses and justify that they are reasonable.

How long will it take for them to return my garnished wages?

default-avatar
Answered by attorney Ronald K. Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
You needed to demand the return of your withheld wages as soon as you filed bankruptcy. Then, if the money wasn't returned, file an action in the bankruptcy court. Now that your bankruptcy is closed. You can still demand the return of the money but you'd have to re-open your case in order to get an order.
